A New Attack on the Constitution

On Wednesday, a federal judge struck down a law allowing the indefinite detention of anyone suspected of terrorism on American soil as a violation of free speech and due process. Two days later, the House made it clear it considered those to be petty concerns, voting to keep the repellent practice of indefinite detention on the books.

On a 238-to-182 vote, it rejected a proposal for something so basic that it is hard to believe there was an argument about it: a formal charge and trial for anyone arrested in the United States. You might have thought that was guaranteed in the Constitution, but that right was stripped away in last year’s military policy bill, signed by President Obama, which made an exception for terror suspects.

Border Control Measures Move Inland With Utah License Plate Tracking Program

Once again the War on Drugs threatens the fundamental rights of ordinary Americans.

Despite protections afforded under the U.S. Constitution, the federal DEA is trying to initiate a blanket sweep of all license plates traveling along Interstate 15 in Utah, with the intent to store the information in a centralized database.

Chicago Militarized for NATO

This writer's residence advised "leaving town between May 18 - 22." Otherwise limit city travel. Have essentials on hand, including food and water. Consider working at home. Avoid certain parts of the city. Observe curfew and other mandates.

No large deliveries will be allowed. Special precautions are being taken. Visitors must have verifying photo IDs. Vehicular restrictions will be enforced. Portions of the building will be locked and inaccessible. Avoid large gatherings if at all possible. Stay close to home.

In early May, CBS local affiliate Channel 2 reported that "the government is informing small plane pilots that if they enter (a restricted) no-fly zone during the summit, they might be shot down."

"This is no joke," the report continued. "It will be enforced from May 19 to May 21."

The FAA established flight advisory rules. Non-commercial aircraft are prohibited from flying within 10 nautical miles of downtown at altitudes below 18,000 feet.

Mystery over Bridgeport arrests: Molotov cocktails or brewing equipment?

According to law enforcement sources and police reports obtained by the Tribune, the arrests were the result of a monthlong investigation into a group suspected of making Molotov cocktails — crude bombs usually created by filling glass bottles with gasoline.

But the National Lawyers Guild criticized the police raid, saying the nine NATO protesters only had beer-making equipment in their possession.

Chicago tourist attractions closed for NATO summit

Several major tourist attractions in Chicago will be closed this weekend because the city is hosting the annual North Atlantic Treaty Organization (NATO) summit of world leaders.

The Adler Planetarium, the Shedd Aquarium and the Art Institute of Chicago will be closed from Saturday the 19th, reopening on Tuesday the 22nd. Under previous arrangements with the U.S. Secret Service, the museums would have only been closed Sunday the 20th.

Erin Hogan, a spokeswoman for the Art Institute, said the decision was made to close the Institute from this time period for logistics reasons, citing employees getting to and from the location. The Museum’s new exhibit examining the works of the artist Roy Lichtenstein will be open to the public on Tuesday the 22nd.

3 protesters charged with conspiracy to commit terrorism

The three men were among nine people that were collared Wednesday night in a raid on an apartment building in the 1000 block of West 32nd in the Bridgeport neighborhood, she said.

She said in a written statement released later Saturday that at 11:30 p.m., “police broke down doors with guns drawn and searched residences without a warrant or consent.”

Gelsomino said she still doesn’t know the details of the charges.

“Although some accusations of Molotov cocktails have been made by police, they have provided no evidence of criminal intent or wrongdoing on the part of the activists,” she said in the statement. “On Thursday, when asked about the raid at a press conference, Police Superintendent Garry McCarthy knew so little about the alleged terrorism investigation that he said he would have to gather further information before commenting.”

The entire case for Molotov Cocktails rests on the possession of glass bottles by the men who were arrested, who, by the way, are home beer makers ... which sort of explains why they have the bottles, doesn't it? Home brewing is legal (unless you sell it) and you usually get a better quality beer that doesn't have all the legally required chemicals added to it. Home brewing/winemaking is a popular hobby ( I used to make my own mead many years ago, and the minister who married my wife and I brews his own beer as well). The police, who obviously chug the cheap stuff that comes in aluminum cans, arrested these guys for their hobby.

$642 billion for the Military? This year? You must be kidding!

The FY 2013 military budget (NDAA) is up for a vote in the House this Friday. It contains more than $642 billion of taxpayer money to pay for a war the majority of Americans oppose; nuclear upgrades that threaten non-proliferation agreements; programs and weapons that even the Pentagon doesn't want. The bill also promotes reckless threats on Iran, enables reckless actions by Israel and prohibits the transfer of prisoners from Guantanamo to the United States.

It's not just the Republicans, who are at fault. The majority of Democrats on the House Armed Services Committee have voted in favor, producing a lopsided 56-5 margin for an outrageous bill. Partisan rhetoric should not obscure the reality that if this over-sized military budget passes the Congress, it will be paid for by programs that affect the most vulnerable- food stamps, school lunches, health insurance for low income children, "Meals-on Wheels" for the elderly.

UK Government Uses Digital Communications Data to Spy on Their Citizens

The UK Home Office (UKHO) has British officials surveying its citizens as part of the government’s annual legislative program.

This is an extensive expansion of the current laws to allow the MI5 data securitization.

UKHO claims they are not snooping through private emails and messages, but rather deciphering where the communications are originating from, who sent it, its length and format.

The 4 billion hours of phone calls, 1 million emails and 130 billion text messages that are expected to be prime source information.

The proposed bill, if passed would place massive amounts of personal data into the hands of the British government. How they use that data is purely at their discretion...

Student Says Holocaust Lesson Went Too Far

AMARILLO, Texas (CN) - A teenager says in Federal Court that he was seriously injured when he was required to role-play as a Jew while taking orders from students in the role of Nazis during an educational exercise about the Holocaust.

"Engaging in this exercise was compulsory, with it constituting 60% of a major test grade for students in their World History Class, and any student who did not do everything they were told were receive a failing grade."

Yara said he was forced to carry three different students to class during the span of one passing period, resulting in severe back injuries that required several medical procedures.
One student who demanded Yara carry him was 170 pounds, while Yara weighed 100 pounds at the time. Another classmate later jumped onto Yara's back while he was still carrying the other student, resulting in a "shocking, burning" pain to shoot down both of Yara's legs from his pelvis, according to the complaint.

MANHATTAN (CN) - New York Times reporter Charlie Savage has lost his effort to expose the U.S. government's secret interpretation of a section of the Patriot Act, a federal judge ruled.

Meanwhile, the dismissal marks the second time that a Manhattan federal judge turned down Savage's attempts to unearth information about national security policies that have troubled civil libertarians.
Last November, U.S. District Judge Robert Patterson snuffed requests for the Federal Bureau of Investigation to break down how many of its inquiries looked into criminal activity versus national security threats.

The New Hampshire House of Representatives voted to ban UN Agenda 21 polices.

This legislation will prevent local, county and state governments from adopting the International Council for Local Environmental Initiatives (ICLEI) programs.

ICLEI is a UN agency that provides “local” community plans, software and training to towns and cities that pay their dues.

Hollande vows to pull from Afghanistan this year

Washington •French President Francois Hollande said Friday he would carry out his pledge to withdraw combat forces from Afghanistan by year’s end, two years earlier than the U.S. ally once planned. He made the declaration to President Barack Obama in the Oval Office.

Speaking after the White House meeting, Hollande said he stands by a campaign promise to withdraw troops, but said France will keep supporting Afghanistan in a "different way." The war, more than a decade old, draws even less public support in France than in the United States.

Protesters rally in Loop, police presence enormous

The police presence in the Loop was enormous Friday afternoon, leaving the appearance that there were several officers per protester.

After a downtown rally that peacefully crossed the Loop, NATO protesters joined forces with organized labor Friday night, lending their voices to striking workers at the Congress Plaza Hotel.

More evidence, if you needed any, that these days of demonstrations in Chicago are about more than the NATO Summit. Young people gathered here say they are looking for opportunity and a way forward.

NATO protesters released from jail

A 36-year-old man from Philadelphia said he and eight others were arrested and detained late Wednesday night after a Chicago police raid at an apartment near 32nd and Morgan.

Darrin Annussek is in town this weekend to participate in the NATO protests. He said he and the eight others were handcuffed to a bench and shackled for 18 hours straight with no communication from police.

He and five others were released Friday without being charged. They were told they were being investigated for felony conspiracy. Three others are still being detained.

A series of events in the last two weeks have set the stage for how surveillance drones will be operated by local law enforcement in the United States and how citizens can demand privacy protections as domestic use escalates. As EFF has previously reported, Congress passed a bill in February mandating the FAA must open national airspace to drones, despite the extensive and unprecedented civil liberties dangers they pose to every American.

The FAA, in new rules announced on Monday, made the authorization procedure easier, stating they have “streamlined the process” for “public agencies”—which includes local law enforcement—to legally operate drones in U.S. skies. Naomi Wolf: The NDAA's section 1021 coup d'etat foiled

US district judge Katherine Forrest, in New York City's eastern district, found that section 1021 – the key section of the National Defense Authorization Act (NDAA) – which had been rushed into law amid secrecy and in haste on New Year's Eve 2011, bestowing on any president the power to detain US citizens indefinitely, without charge or trial, "facially unconstitutional". Forrest concluded that the law does indeed have, as the journalists and peaceful activists who brought the lawsuit against the president and Leon Panetta have argued, a "chilling impact on first amendment rights". Her ruling enjoins that section of the NDAA from becoming law.

In her written opinion, the judge noted that she had been persuaded by what the lead plaintiffs – who include Pulitzer prize-winner Chris Hedges of the Nation Institute, editor Jennifer Bolen of RevolutionTruth, Noam Chomsky, Daniel Ellsberg, co-founder of Occupy London Kai Wargalla, Days of Rage editor Alexa O'Brien, and the Icelandic parliamentarian and WikiLeaks activist Birgitta Jónsdóttir – had argued. In their testimonies (in court and by affidavit), these plaintiffs compiled a persuasive case that they had "standing" to sue because it was reasonable for them to worry that they could conceivably could be detained indefinitely under the section 1021 law because their work requires them to have contact with sources the US government might assert were "terrorists" or "associated forces" of al-Qaida.

Chicago cops start preemptive arrests on the eve of NATO Summit

The National Lawyers Guild confirms that law enforcement agents broke down the door of a 6-unit apartment building in the Chicago, Illinois neighborhood of Bridgeport at around 11:30 pm on Wednesday. Once inside, they entered the apartment of known activists with guns drawn and then cuffed the residents.

For two hours, tenants were shackled and questioned by officers with the Organized Crime Division of the Chicago Police Department. The Chicago Tribune writes that police reports detailing the incident have been obtained by the newspaper and confirm that nine people were arrested in the raid for allegedly making or possessing Molotov cocktail explosives. Police sources add to the paper early Friday, however, that none of the suspects had been charged.

The Empire Holds Its War Council in Chicago

If anyone has doubts about what it means here at home when the U.S. seeks to militarily dominate the world, take a trip to Chicago, this week. 'No indication' of terror threat to Chicago NATO summit-FBI

FBI agent Ross Rice said the agency will be on heightened alert in Chicago, with extra agents brought in to react if its intelligence network sniffs out a plot. The FBI has agents in 70 countries, gathering intelligence.

"Several international terrorist groups have elevated Chicago in their mind to their No. 1 target for terrorist attack," Rice said in an interview at the U.S. government's nerve center inside a non-descript suburban Chicago office complex. Reporters were asked to keep the location secret.

"But there's absolutely no indication that we've developed that any group or organization has a plan afoot to disrupt the summit this week," Rice said.

OK, if "...there's absolutely no indication that we've developed that any group or organization has a plan afoot to disrupt the summit," then why the flip is Chicago in lockdown, surveilled from the skies, and people being warned that they may want to leave certain buildings when the conference is being held, not to mention the horrendous expense?!?

Is this simply an exercise by the US government, simply to demonstrate a show of force to NATO against its own citizens?

I can only think back to when APEC was hosted here on Oahu, and I could not get to my church to sing with my choir because army tanks prevented the left hand turn on to the main highway leading to the church. Let me repeat that, and here in the "aloha state", of all places: I could not get to church because making the left hand turn on the way to my church could have gotten me shot!

If there is no real threat, what other reason could there be for the overkill, both here on Oahu, and in Chicago, other than wanting to show various dignitaries from various foreign countries that they can inconvenience and oppress American citizens with utterly zero consequences?!?

She was uncooperative, but did not offer any violent resistance.

Her sole “offense” was to refuse a demand that she sign a traffic ticket that was eventually dismissed.

In a 68-page ruling blocking this statute, U.S. District Judge Katherine Forrest agreed that the statute failed to "pass constitutional muster" because its broad language could be used to quash political dissent.

"There is a strong public interest in protecting rights guaranteed by the First Amendment," Forrest wrote. "There is also a strong public interest in ensuring that due process rights guaranteed by the Fifth Amendment are protected by ensuring that ordinary citizens are able to understand the scope of conduct that could subject them to indefinite military detention."

Senators to Unveil the ‘Ex-Patriot Act’ to Respond to Facebook’s Saverin’s Tax ‘Scheme’

At a news conference this morning, Sens. Schumer and Bob Casey, D-Pa., will unveil the “Ex-PATRIOT” – “Expatriation Prevention by Abolishing Tax-Related Incentives for Offshore Tenancy” – Act to respond directly to Saverin’s move, which they dub a “scheme” that would “help him duck up to $67 million in taxes.”

The senators will call Saverin’s move an “outrage” and will outline their plan to re-impose taxes on expatriates like Saverin even after they flee the United States and take up residence in a foreign country. Their proposal would also impose a mandatory 30 percent tax on the capital gains of anybody who renounces their U.S. citizenship.

This is grandstanding, and would be considered an "ex post-facto" law, should it be passed; and I would seriously doubt that the Supreme Court would ultimately let such a law stand.

Schumer and Casey are simply belching fire here because the public nature of this citizenship renunciation of by Saverin pointed out, very publicly, that naturalized Americans CAN do this, if they so choose.

But what about the huge American corporations which duck billions of taxes by offshoring American jobs and taking the tax advantages this practice allows?!? Shouldn't something actually be done here?!?

But of course, that will happen when pigs fly, because these same huge corporations own Congress, due to their generous overt and covert campaign support.

Dropping Planes, Not Bombs: US Attack on Iran with F-22 Stealth Fighters would be Laughable

The Iranian military must be enjoying the latest spectacle of Pentagon waste and bungling.

Only a few weeks ago, the US attempted to ramp up the pressure on Iran by deploying to the Persian Gulf at the Al Dhafra Air Base in the United Arab Emirates, just across the gulf from Iran, a squadron of the Air Force’s spanking new and never battle-tested supersonic F-22 stealth fighter-bombers.

The problem is that those F-22 Raptors are duds. They may fly fast, and may even be hard to spot on radar (though that claim has been debunked by many experts), but they have a fatal defect in their life-support system. Pilots who fly them have been having their oxygen supply cut off with disturbing regularity, leading to deaths, crashes and to forced landings by pilots who realized they were getting dopey or losing consciousness.

Today, May 16, 2012, the United States Premier Barack Obama AKA Barry Soetoro AKA Barry the Rat signed Executive Order Blocking Property of Persons Threatening the Peace, Security, or Stability of Yemen, declaring a State of Emergency in the United States and activating his new dictatorial powers, including the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) (IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq.) (NEA), and section 301 of title 3, United States Code.

Obama says he is going to exercise these powers on the sovereign country of Yemen and “others”. This is a seizure of all Yemenis owned properties in the United States and the properties of any American with business ties to any interest in Yemen. This is an act of war.

This is, once again, Obama circumventing our Congress and declaring himself as dictator as he is absolutely dictating foreign policy using unconstitutional laws which were put in place through his prior dictates.

US DEA Kills Innocent Civilians in Honduras -- US Media Silent

According to the Honduran newspaper, Tiempo, as well as the Honduran human rights group, COFADEH, the agents of the U.S. Drug Enforcement Agency (DEA), dressed in military uniforms, killed at least four and possibly six civilians in a raid which took place on Friday, May 11. The victims included two pregnant women and two children. The newspaper Tiempo did not pull any punches, writing that those killed "were humble and honest citizens." Apparently, the DEA agents fired from helicopter gunships upon a boat carrying civilians on the Patuca back to their community of Ahuas which itself is located in the Mosquito coast of Honduras. According to Tiempo, the DEA mistakenly fired upon the civilian boat because it was well-lit while the intended target -- a boat carrying drug traffickers -- was floating down the river without its lights on.

Further, the DHS "shall, at the discretion of the agent supervising the search, remove, photograph or seize as evidence" any of the following items "bar gold, gold coins ..."

If people have their emergency money in a safe deposit box or an account in a bank that closes, they will not be allowed into the bank to get it out. They can knock on the door and beg to get in but the sheriff’s department or whoever is handling the closure will simply say “no” because they are just following orders.

Webmaster's Commentary: 

In other words, when the manure hits the ventilation system, the US Government will loot your bank accounts and anything of value in your safety deposit boxes to save the bankers. FDR did this in 1933 confiscating gold, and Bush/Obama did it confiscating private homes in 2008-2012.

Our advice is to keep in the bank only that money needed to cover your checks and keep the rest of your money and valuables at home. Invest in a safe that bolts to the floor, and a shotgun.

Former Security Officials: Outlawing Indefinite Detention for Suspects Would ‘Reward Terrorists’

The letter argues that any change in the law that would restrict the ability of the federal government to indefinitely detain suspects without charges would amount to “rewarding terrorists” and would make terror attacks more likely. It goes on to claim that removing the law would be unconstitutional because—and get this—it would restrict the president’s ability to “fulfill his constitutional duties as commander in chief.”

Rep. Smith defended the efforts to ensure that people arrested actually eventually get to a court, saying that the letter was “disingenuous and purely political.” Though Congress cheerfully passed the NDAA by a wide margin, a massive public backlash against the law has a number of its former proponents looking for cover, and fearing that their support for indefinite detention could harm their reelection.

Indefinite detention without due process is an in-your-face human rights violation, despicably worthy of either the old Soviet Union,or present day Israel, which uses it as a tool of collective punishment against Palestinians.

Anyone in Congress who voted for this abomination should be voted out of office as quickly as humanly possible, period, end of discussion.

Homelessness and Despair in New York City

The number of homeless people living on the streets of New York City increased by 23 percent in one year according to an annual survey conducted by the city’s Department of Homeless Services.

On January 30, volunteers for the organization counted an estimated 3,262 people living on the streets— a 23 percent increase from the 2,648 counted in 2011. The 2,925 volunteers walked approximately 15,000 miles while surveying the city. The largest numbers of homeless people living on the streets were found in Manhattan and Brooklyn. About half of the total number of people accounted for in the survey were living inside the city’s subway system.

But in their hunger, the strikers are acquiring names. I do not mean names on an obscure website, but ones that appear repeatedly in the daily press and on television, and have wide circulation in the social media. The most prominent name is that of Khader Adnan, a baker and MA student in economics at Birzeit University in the West Bank. Adnan was released from an Israeli jail after 66 excruciating days of hunger strike that commenced on February 21 of this year. He opted for self-starvation to protest what legal jargon calls “administrative detention,” which in this case amounted to abduction by a foreign state that had no legal grounds whatsoever for seizing him.

Federal Reserve Bank made profit of $77 billion in 2011
